The contractual and operational complexities of the banking and financial business are the source of many disputes, whether between investors and financial/banking companies or exclusively between financial/banking companies.
Through the mediation process, parties may quickly and amicably resolve disputes about brokerage, including those in the banking and lending areas.
ADR Center is Italy's first mediation provider registered with the National Register of Mediation Organizations kept by the Ministry of Justice. Our mediation procedure complies with all of the requirements of Articles 38-40 of Decree n. 5 of 2003.
The following lists the main outcomes of the above legislation:
- Suspension of the limitations prescribed by law
- If a mediation is prescribed by a mediation clause and the procedure has not yet commenced, upon a party's motion the judge may suspend the process and set the period within which the parties should submit a mediation request to a provider
- Settlement agreements are enforceable by the judiciary
- Parties' final positions and/or their failure to attend a mediation procedure are evaluated by the judge in his assessment of legal fees and
- Tax benefits
